On November 18, the Chief Judge Council approved changes to the following adult and juvenile sex offense probation supervision documents:
- Additional Changes of Probation for Adult Sex Offenders (JDF 446)
- Additional Changes of Probation for Juveniles Who Commit Sexual Offenses (JDF 465)
- PSI boilerplate language regarding contact with minors
- Explanation of No Contact/Restricted Contact with Children (renamed Explanation of Restrictions On Contact with Children for Adult Sex Offenders Sentenced to Probation) You will find this from at probation, distributed by probation officers as opposed to being distributed by the courts.
Among other things, the adult and juvenile additional conditions were amended to reflect that a probationer is permitted to have contact with minor siblings and minors with whom the probationer has a parental role unless the minor is a victim or the Court orders otherwise.
- Form JDF 446 see sections 6 and 7.
- Form JDF 465 see sections 5-9.
The PSI boilerplate language was amended to alert the court that the child contact default has changed and that contact will be permitted absent a Court order to the contrary. A “boilerplate” are blanks that are added to a document in order to indicate specifics. In this case, the boilerplate language reads “will be permitted to have contact with the probationer’s own child(ren) and minor siblings” This is what the language will read unless a judge has made an order that states something different for Sex Offense Probation.
The child contact form was amended to provide probationers with relevant information regarding contact with minors. PAY EXTRA ATTENTION TO THIS.
These new Sex Offense Probation forms, which will all be provided through probation can be located below. The new forms are now in effect.
